Is there a way to get the SMT-H3090 home networking capability to work even though Time Warner cable has not set it up

The only company I have found selling this box is Time Warner Cable. Are there any actual stores or websites selling this product? I have Charter cable. Isn't this box supposed to work with any cable provider? I am sick of paying $30 for a box with DVR service.
